Unicoin sues Uniswap over UNI trademark dispute

  • Unicoin has filed a lawsuit against Uniswap Labs after receiving demands to stop using the UNICOIN name.
  • The plaintiff claims that UNICOIN does not infringe Uniswap's UNI, UNISWAP, and UNICHAIN trademarks.

Unicoin has filed a lawsuit against Uniswap Labs in New York federal court. The dispute concerns the UNI trademark.

The lawsuit follows a series of claims from Uniswap. In June, DEX lawyers insisted that Unicoin cease using the UNICOIN name and transfer the unicoin.com and unicoin.org domains. Unicoin responded that its brand does not infringe on the UNI, UNISWAP, and UNICHAIN trademarks, as the company independently developed the name and has been using it since 2021.

In response, Unicoin is demanding the annulment of Uniswap's federal trademark registration for UNI. Furthermore, "uni" is a common prefix, weakening Uniswap's claim to exclusive rights.

There were other complaints that prompted Unicoin to file a lawsuit. The company's lawsuit states that the companies' products and branding differ. UNICOIN positions itself as an asset-backed cryptocurrency, while Uniswap operates a decentralized exchange with the UNI governance token and the Unichain blockchain. Unicoin also stated that over the years of its operation, there have been no instances of consumers confusing the two companies. This is especially true given that over 3600 properties bearing the name UNI are registered in the United States Patent and Trademark Office database, with approximately 1,000 of them currently in use.

Interestingly, the lawsuit came shortly before Unicoin's planned public offering. The company believes Uniswap's demands came at an inopportune time and could hinder its plans. Therefore, the firm's lawyers are now seeking official confirmation of the right to use its name and logo, as well as reimbursement of legal costs.
